Part B - Account Terms and Conditions of Use
Part D - Standard Promotional Terms
Welcome to Betfair. We offer you access to the world’s largest betting exchange.
If you wish to bet, you will need to open an account with us. By opening an account with us, you agree to be bound by our Account Terms and Conditions of Use.
Before beginning to bet, you should read through our Betting - General Conditions as well as the "Specific Conditions" which apply to you and to each of your betting transactions as set out below.
By entering into any betting transactions on our site, you agree to be bound by both the Betting - General Conditions and the specific conditions applicable to that particular betting transaction:
Welcome to Betfair. Before you can use our services, you need to open an account and deposit funds.
Please read these Terms and Conditions carefully before opening an account with us.
Please also read our Privacy Policy, Cookie Policy, Trust Deed and the provisions regarding the Betfair Charges which are incorporated by reference into these Terms and Conditions. If there is any inconsistency between these Terms and Conditions and any of the documents listed above, these Terms and Conditions will prevail.
By clicking the "Sign Up" button on the account opening screen, you agree to be bound by these Terms and Conditions.
If you reside in Australia or New Zealand, you will be opening an account with Betfair Pty Limited and references in these Terms and Conditions to "Betfair", "we", "us" or "our" will be to Betfair Pty Limited. Betfair is licensed and regulated by the Northern Territory Racing and Wagering Commission. Betfair is the holder of a betting exchange licence issued under the Racing and Wagering Act 2024 (NT).
In consideration of our accepting your application to open an account, you represent to us (and acknowledge that we rely on these representations) as follows:
It is your responsibility to keep your contact details up-to-date on your account. Failure to do so may result in you failing to receive important account related notifications and information from Betfair.
You are solely responsible for the security and confidentiality of your account. In particular, you agree to keep your username, password and/or TAN strictly confidential and you are responsible for any misuse of your password and/or TAN. Please note that when you create an account you have the option to use your email address or a username to log in to/identify your account. This can reduce the security levels of your account as your email address may be more accessible and this makes it easier for third parties to gain access to your account.
Provided that we have been correctly supplied with the account information requested, we are entitled to assume that offers and payments are made by you. You should change your password on a regular basis and never disclose it to any third party. You undertake to protect your username and password in the same way that you would in respect of your bank cards and any failure to do so shall be at your sole risk and expense. If another person accesses your account, you are solely responsible for all their actions whether or not their access was authorised by you and you hereby indemnify us and hold us harmless against all costs, claims, expenses and damages howsoever arising in connection with the use of or access to your account by any third party.
You will not attempt to sell or otherwise transfer the benefit of your account to any third party and nor will you acquire or attempt to acquire an account which has been opened in the name of a third party.
For information on inactive accounts, including any applicable administrative fees and the procedure by which a customer will be informed that such a fee will be charged, please see section 8 of the Betfair Charges – “Inactive Account Fees”.
If you would like information about tools to help you manage your gambling activity, please visit Betfair's Safer Gambling website by going to https://www.betfair.com.au/info/responsible-gambling/. To bet on Betfair, you need to deposit funds. Except as set out below, all funds in customer accounts are held by The Sporting Exchange (Clients) Limited, a group company established solely for the purpose of holding customer funds (the "Trustee"), under the terms of the Trust Deed (the "Trust Fund"). Holding your money in the Trust Fund has the following benefits to you:
Your funds will not be held by the Trustee if: (i) there is a requirement for such funds to be held under the terms of any licence, in a separate non set-off bank account in the name of the licence holder; or (ii) where such funds are deposited via a third party payment provider (hereafter referred to as a "Payment Provider"). Funds deposited via a Payment Provider may take a few days before they are held by the Trustee under the terms of the Trust Deed. During this period your funds will be held in the account of the relevant Payment Provider and will not be protected under the terms of the Trust Deed. Depositing by any method other than the following will be classed as a deposit via a third party Payment Provider: (a) bank transfer and (b) debit card.
The funds in your account are held on your behalf by way of security to meet any payment obligations you may incur as a result of betting on our site or using any of the products or services supplied by Betfair. Details of the manner in which the Trust is operated are set out in the Trust Deed.
You undertake that:
You accept that all transactions may be checked to prevent money laundering and that any transactions made by you which Betfair deems suspicious, may be reported to the appropriate authorities.
You accept that you will not be entitled to receive any interest in respect of your deposits (for more information see clause 5 of our Trust Deed), and you acknowledge that you shall not treat Betfair as a financial institution.
The methods available for deposit of funds can be found once you are logged into your Betfair account, and then by clicking on the “Deposit” button found at the top right-hand side of our home page.
The methods available for withdrawal of funds can be found once you are logged into your Betfair account by clicking on the “My Account” icon and then (a) FOR MOBILE, by selecting the “Withdraw” button and selecting the payment method you would like to withdraw the funds to, and (b) FOR DESKTOP, by selecting the “My Betfair Account” from the drop-down menu, where you will see the “Withdraw" option available.
Withdrawals will be remitted only to an account in the customer’s name. If Betfair detects third-party payments or withdrawals on an account, Betfair may cancel the deposit or withdrawal.
Betfair may operate what’s called a ‘Net Deposits Closed Loop Policy’ when it comes to withdrawing funds. If you have deposited into your Betfair account using one payment method, you may be required to withdraw back onto that same payment method.
The average time required for deposit/withdrawals via each of the methods available can be found here.
The information that you send to us will be processed in accordance with our Privacy Policy.
You authorise us, at any time, to use any means that we consider necessary to verify your identity and creditworthiness with any third party providers of information.
As set out in our Privacy Policy, Betfair will:
a. include functional unsubscribe facilities in emails and SMS text messages that contain marketing or promotional material; and
b. not include functional unsubscribe facilities in push notifications that contain marketing or promotional material. Customers can unsubscribe from receiving push notifications via the Betfair preference centre which is accessible by customers.
You acknowledge that Betfair and its affiliates will hold information with respect to your identity, including but not limited to your name, address and payment details. You agree that we rely on this information in entering into our agreement with you and you agree to hold us harmless against any falsehood or inaccuracy contained in the information you provide us.
You will inform us as soon as you become aware of any errors with respect to your account and you will forfeit any amounts shown to be in your account that result from human error or technical fault.
Either we or you may suspend or terminate your account at any time, either with or without cause, upon notice (we will use our reasonable endeavours to give such notice to you either before or after suspending or terminating your account). Please contact the Betfair Helpdesk if you would like to close your account.
We may take steps to block you from betting on or using our site (or any part of it) if you are located in certain jurisdictions, for example the United States of America.
Following termination or suspension of your account, the Trustee will, in the normal course of events, return any funds in your account to you in accordance with the Trust Deed. Please contact the Betfair Helpdesk to recover any funds held in suspended or closed accounts.
However, we reserve the right to notify the Trustee to withhold the funds in your account from you pending the determination of any investigation (including any relevant external investigation) where:
In addition, if formally requested by the police, gambling regulators or taxation or other authorities or in the event that you fail to provide us with sufficient information to identify yourself in accordance with our own internal procedures or those imposed on us by regulatory authorities (wherever based) we may suspend your account and all functionality relating to the use of your account (e.g. bet management and withdrawal of funds) and notify the Trustee to withhold from you any funds in your account pending determination of any criminal or other legal proceedings or investigation to which such a request may relate or until you provide the necessary 'know your customer' or 'age verification' information as appropriate.
Following the determination of any such investigation as anticipated by the preceding two paragraphs we reserve the right to withhold indefinitely some or all of the funds in your account (by notifying the Trustee that the funds in your account should be released to us) in circumstances where we are legally entitled to do so. We will deal with any funds obtained by us in this manner in accordance with any advice, request or instruction from any governmental, regulatory or enforcement authority.
For the avoidance of doubt at no point during any such period will interest accrue to you on any funds in your account.
7.1.1 Betfair is committed to ensuring its customers gamble responsibly. It's safer gambling policies include:
7.1.2 For more information on any of the above tools, please visit the Betfair Safer Gambling microsite or the ‘Player Protection’ page which is available in the ‘My Account’ section of the Betfair website.
Betfair provides a self-exclusion facility to help you if you consider that you need to control your gambling. If you request a self-exclusion, we will, as soon as is reasonably practicable, apply best practices to prevent you from using your account indefinitely. To this end, we may retain such personal data as is necessary (and for as long as is necessary which may be indefinitely) to implement the facility as effectively as possible (including for example your name, address and debit card details).
To activate our self-exclusion facility, please contact the Customer Services team or visit the ‘Player Protection’ page which is available in the ‘My Account’ section of the Betfair website.
Our self-exclusion facility involves a joint commitment between Betfair and you. During a period of self-exclusion, we will take reasonable steps to prevent you re-opening your account or opening a new account but you must not attempt to re-open your account or to try and open new accounts.
You agree that you will not access any other Betfair account to use any of our services or products from which you have excluded, during the period of any such self-exclusion.
Self-excluding from Betfair will not affect your marketing preferences with third parties, including with advertising websites or other third party affiliates. We strongly recommend that you also contact such third parties and opt out from receiving any gambling related communications from them.
If you or someone you know wishes to self-exclude from all licensed wagering operators, for a period of 3 months and up to a lifetime, please see the Australian National Self-Exclusion Register, BetStop. Call 1800 238 786 or visit https://betstop.gov.au for more information.
7.3.1 Betfair Pty Limited operates Betfair in accordance with a betting exchange licence issued by the Northern Territory Racing and Wagering Commission. Betfair Pty Limited also holds a sports bookmaker licence issued by the Northern Territory Racing and Wagering Commission. Pursuant to the sports bookmaker licence, Betfair Pty Limited operates an online sportsbook branded 'CrownBet' (CrownBet). The Betfair platform is completely separate from the CrownBet platform.
7.3.2 You acknowledge and agree that:
8.1. For the purpose of this Clause 8, “suspicious betting” shall refer to where we have reasonable grounds to believe that a bet or a number of bets have been placed in suspicious circumstances. Suspicious betting shall include, but not be limited to:
8.1.1. where there is an inordinate frequency and/or highly unusual pattern of bets (by comparison with betting norms) placed on the same selection(s) in a short space of time;
8.1.2. where there is an inordinate frequency and/or highly unusual pattern of bets placed on the same selection(s) and where the theoretical probability of said selection(s) winning at the time of bet(s) placement, based on the odds offered on the selection(s) at the time of bet placement, is largely inconsistent with the theoretical probability of the same selection(s) winning calculated using their accumulated starting prices. By way of illustrative example only, if there was an inordinately large number of bets placed on a multiple or permutation with combined odds of 250/1 (with a theoretical 0.004% probability of winning based on the odds) and that same multiple or permutation had combined odds of 12/1 based on the Starting Prices of the selections (a theoretical 7.7% probability of winning), this may trigger the suspicions contemplated by this clause 8.1.2;
8.1.3. where the integrity of an event (or events) has been called into question, including, for example, but not limited to where one (or more) of the participants in an event displays exceptional form which we reasonably believe was known to you or someone connected to you at the time of bet placement but was concealed from the public generally in order to gain an unfair advantage in any bets placed on that event (or those events);
8.1.4. where we reasonably believe that you have used unfair external factors or influences connected with the event(s) the subject of any bet(s);
8.1.5. where we reasonably suspect that you have opened duplicate accounts or where we reasonably suspect that second or subsequent accounts are under common control with your account with a view to concealing the true worth, nature or pattern of bets placed by you or on your behalf, even if second or subsequent accounts are opened under different names;
8.1.6. where we otherwise believe, acting reasonably, that you are acting in concert with others or that you are acting other than on your own behalf; or
8.1.7. where we reasonably believe that bets have been placed from a location or device other than the location or device which you claim to have used to place a bet; or
8.1.8 where we identify a pattern of bets that have been placed in quick succession by different or the same account holder(s) that have a combined liability which exceeds what we would expect to accrue on similar bets during a particular time period based on long term established betting trends. For example, we would regard a series of bets placed on the same or similar selections in quick succession after 9:30pm and before 8:00am by different accounts with a combined liability that exceeds $200,000 as suspicious as this is conflicts with our long term established betting trends.
8.2. In the case of any of the activities contemplated by Clause 8.1, and without restricting our ability to rely on other remedies that may be available to us, we may, acting reasonably, and depending on the circumstances:
8.2.1. request such further information from you as may reasonably be required by us to investigate whether the bet or bets constitute suspicious betting for the purpose of Clause 8.1;
8.2.2. suspend or withhold payment of any amounts (or any parts thereof) pending the receipt by us of satisfactory evidence from you in order for us to determine (acting reasonably) that a bet does not constitute a suspicious bet as such term is referred to in Clause 8.1. For example, but without limitation, where we suspect that a bet or a string of connected bets may have been placed robotically or by automated means, we may require you to provide reasonable evidence that each bet was placed manually by you via your account. You further acknowledge and accept that we reserve the right, at our sole discretion, to collect and process any information in connection with your betting patterns, personal data, depositing of funds and any other related information and inquiries that will help us to investigate any suspected breach of these Terms and Conditions;
8.2.3. suspend or withhold payment of any amounts (or any parts thereof), usually for no longer than 30 days but where relevant for such longer period of time as may reasonably be required (for example, pending any investigations by Betfair, any sports governing body, a gambling regulator, a law enforcement authority or any other third party);
8.2.4. void a bet or a string of connected bets (including for example multiples) prior to the event. Where possible, we shall communicate to you in advance that the bet(s) has (or have) been voided prior to the (first) event the subject of the bet(s); or
8.2.5. calculate any winnings based on the starting price of the event(s) the subject of the bet(s). Where possible, we shall communicate to you in advance that any bet(s) will be settled at the starting price.
8.3. Where we have reasonable grounds to believe that you have participated in, or have been connected with, any type of suspicious betting, we shall use our reasonable endeavours to investigate such matter, including but not limited to through the use of various collusion, suspicious betting, fraud and cheating detection practices which are used in the gambling industry.
8.4. We reserve the right to terminate an account if we reasonably suspect any of the activities described in Clause 8.1 in connection with that account.
8.5. Where a bet is deemed to be, or is declared, void by us prior to an event, any sum deducted from your account with respect to that bet shall be credited to your account.
8.6. We reserve the right to seek to recover from you any losses we suffer that are directly or indirectly connected to any of the activities contemplated in Clause 8.1. This right is without prejudice to any other rights (including common law rights) that we may have against you, whether under these Terms of Use or otherwise.
8.7. We will not be liable under any circumstances whatsoever for any loss you or any other person may incur as a result of the collusive or other behaviour in breach of this Clause 8. Further, we reserve the right, but shall not be obliged, to take any other actions in the case of any of the activities contemplated in Clause 8.
8.8. In exercising any of our rights under this Clause 8, we shall ensure that we exercise such rights in a manner which is fair to you and to our customers generally. If you have any comments or queries in respect of this Clause 8, please do not hesitate to contact us.
You may not assign these Terms and Conditions to any third party. Betfair may assign, transfer or novate any or all of its rights and obligations under these Terms and Conditions to any third party at any time. In the event of an assignment by Betfair, we will notify of this change and, if you do not agree to this, then you will not be able to continue to use our services, but you shall always be able to withdraw your funds subject to these Terms and Conditions.
In the event that any provision of these Terms and Conditions is deemed by any competent authority to be unenforceable or invalid, the relevant provision shall be modified to allow it to be enforced in line with the intention of the original text to the fullest extent permitted by applicable law. The validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected.
Any provision of these Terms and Conditions that is invalid, illegal or unenforceable in any jurisdiction will be ineffective in that particular jurisdiction, without affecting the validity, legality or enforceability of that provision in other jurisdictions.
Our aim is to offer you the greatest customer experience possible. We want to ensure that all of our customers are fully satisfied with the products and service we offer. However, we recognise that there are those rare occasions where we have not been able to meet your expectations. If you are not happy with the service provided you can raise your query with our Customer Services team by sending an email to service@betfair.com.au.
If you have raised a dispute or made a complaint to Betfair and you are not satisfied with Betfair’s decision in relation to your dispute or complaint, you can lodge a dispute/complaint with the Northern Territory Racing and Wagering Commission via the online “wagering complaint form” found here.
We reserve the right to make immaterial changes to these Terms and Conditions at any time.
If we make any material changes to these Terms and Conditions, we will give you as much prior notice of such changes as is reasonably practicable but, in any event, customers will be notified of material changes before they come into effect. Material changes will be communicated to you via a pop-up message on web and/or mobile when you log into your account. After being informed of the changes, you will be asked to ‘Agree’ to the changes to continue to use our services. Your continued use of the services after being notified of the material changes, and after indicating your acceptance of them, will be deemed to be your acceptance of the changes. If you do not agree to the material changes, then you will not be able to continue to use the services, but you shall always be able to withdraw your funds subject to these Terms and Conditions.
Communications and notices to be given by you to us under these Terms and Conditions should be provided to us via email to service@betfair.com.au.

You understand that you may lose money on bets placed and accept that you are fully responsible for any such loss. You accept that under no circumstances will any amounts lost by you under any bet be recoverable from us.
It is your responsibility to verify that you are permitted to bet with us according to the jurisdiction of your domicile or habitual residence and/or in which you are located and you agree that you will not bet with us while you are located in a jurisdiction which prohibits you from betting with us. In particular, you will not bet or attempt to bet with us if you are located in the United States of America or in any other country with a comparable legal situation. These countries will be determined by Betfair from time to time.
You undertake to use our services for legitimate betting purposes only. In particular you undertake not to:
You will not attempt to use the Exchange to deliberately transfer money from one Betfair account to another by attempting to match bets on a Market with another account through collusion.
You will inform us as soon as you become aware of any errors in calculations with respect to any betting transaction. We reserve the right to declare null and void any bets which are the subject of such an error.
You will not disguise or interfere in any way with the IP address of the computer you are using to access the site or otherwise take steps to prevent us from correctly identifying the actual IP address of the computer you are using whilst accessing the site.
You agree it is your responsibility to account for any tax or duty imposed on you as a result of any of your betting transactions.
You will not make offensive comments, use offensive or pornographic material or make potentially defamatory or inflammatory remarks in connection with the forums or any other part of our site including within your own username or other information contributed to our site.
Any information you send to us will be processed in accordance with our Privacy Policy.
You authorise us, at any time, to use any means that we consider necessary to verify your identity and creditworthiness with any third party providers of information. If you are an Australasian Customer, you consent to have your identity verified using credit data information sourced on behalf of us by illion Australia Pty Ltd (or such other third party that we may use from time to time).
We reserve the right to record ALL telephone calls to and from Betfair and to monitor all information relating to betting activities.
You agree to indemnify us and hold us harmless in respect of the release of any personal (or other) data pursuant to this Agreement.
You are responsible for understanding the contents of our site and the operation of the Services and we reserve the right to change the format of the Services in order to enhance such Services.
We may determine when the Markets are open for betting and may close the Markets at any time in our absolute discretion. Though we will at all times use reasonable endeavours to settle Markets as quickly as possible, we give no assurances as to the timeframe in which Markets will be settled.
You are entirely responsible for the information that you provide to us concerning the offer that you wish to place. We will not enquire into the reasonableness of any offer that you may make. We will not be liable for incorrect entries made by you, including data input errors with respect to the odds, price or stake on offer, or incorrect bet requests communicated by you to a Betfair Telephone Operator. If a Betfair Telephone Operator repeats back your bet request incorrectly, it is your responsibility to correct the bet request and inform the Betfair Telephone Operator of the error. Once you have confirmed the bet request to the Betfair Telephone Operator (whether or not that was the original bet that you requested) and your bet is matched, you will be liable for that bet if it loses.
Betfair may, in its sole and absolute discretion, decide to suspend betting on a Market at any time (even if such suspension is earlier than anticipated by our Exchange Rules and Regulations). In the interests of maintaining integrity and fairness in the Markets, Betfair may also void certain bets in a market or void a whole Market in its entirety.
You should be aware that some customers make use of programs designed to automatically place bets within certain parameters set by them (e.g. to back or lay at a certain price) ("bots"). These bots may be active in any or all Markets at any time and you should not assume that you can place bets on quiet Markets that will not be automatically matched simply because the Market otherwise appears quiet. Additionally bot users should be aware that bots might be prone to exploitation by other customers.
For regulatory reasons, your session may be timed out as a result of a period of inactivity on your account. You acknowledge that it is your responsibility for leaving your account unattended during such period.
We may restrict your access to Betfair, suspend or terminate your account, withdraw your offers for bets, void any bets outstanding to your account, cancel any unmatched bets or cancel and void any outstanding or matched bets in our absolute discretion without cause at any time including if:
In relation to any cancelled or void bets, we reserve the right to notify the Trustee that any money in your account relating to these bets be paid to us in accordance with the Trust Deed or, if there are insufficient funds in your account, demand that you pay us the relevant outstanding amount relating to these bets.
It is an offence for anyone under the age of 18 to open an account or to gamble on Betfair. If we identify that you are under 18 or were under 18 when you entered into any betting transactions on our site ("under age"):
You may cancel unmatched bets at any time either by:
Your cancellation of an unmatched bet becomes effective once we send you confirmation of the cancellation. In the event that your cancellation request is not received and processed in good time, you acknowledge that your offer may remain outstanding and available for acceptance.
You may not be able to cancel your offer if your bet has been partially or wholly accepted during the interval between your submitting your cancellation request and our confirming your cancellation. In this case, your original offer, or part thereof, will be validly accepted and the bet will be concluded.
When you amend an unmatched bet you are effectively cancelling that bet and submitting a new bet at the amended stake or odds.
We will cancel any offers for bets that remain outstanding at the time that we close a Market.
Depending on the product or type of market you are betting on and depending on the currency that you are betting in, there are minimum bet sizes that apply. These minimum bet sizes are subject to change and may differ depending on whether you are on our site or using the Telephone Betting Service. You are not permitted to place bets or try to place bets that are below the minimum bet size threshold and doing so may result in your account being permanently closed.
Your betting limit is represented by the lesser of: (i) your 'Available to Bet' balance shown in your account and (ii) your "Exposure Limit" (which is available in the "Account Summary" tab in "My Account"). However in the event that we process an offer for a bet or the acceptance of a bet in an amount outside the applicable thresholds, such bet will nevertheless stand.
Subject to these General Conditions and any applicable Specific Conditions we will settle Markets in accordance with our Exchange Rules and Regulations. We reserve the right to reverse or amend settlement in the event of a Market being settled incorrectly. This may lead to amendments being made to your account to reflect changes in Market settlement and if there are insufficient funds in your account we may demand that you put funds into your account to address the outstanding balance. We will notify you if your account goes into a negative balance (i.e. that you owe Betfair money) and, if following the notification, you either:
Any amount of winnings or losses relating to your bets on a Market will be rounded to the nearest two decimal places. If the amount ends in 0.5 it will be rounded up.
You are not permitted to place bets or try to place bets which deliberately take advantage of Betfair rounding off to the nearest penny or cent. Any bets which seek to do so will be automatically cancelled.
We charge a commission calculated by reference to your net winnings on a Market. Your stakes for bets placed on the Exchange are therefore not relevant for the calculation of the commission you pay. In particular, these stakes do not represent remuneration for the Services in connection with the Exchange.
In certain specified circumstances, you may also incur certain other charges. Please refer to Betfair Charges which sets out in detail how all commission and charges are calculated.
We reserve the right to amend our policy as set out in Betfair Charges as amended from time to time.
We will calculate the amounts that you owe us and notify the Trustee accordingly. The Trustee will deduct such amounts from your account and will pay such amounts to us in accordance with the Trust Deed.
Any amounts owed to us will be rounded to the nearest two decimal places. If the amount ends in 0.5 it will be rounded up.
Without prejudice to our obligations contained within the various laws and regulations of the jurisdictions where we are licensed, we are not liable for any loss or damage that you may suffer because of any: act of God; power cut; trade or labour dispute; act, failure or omission of any government or authority; obstruction or failure of telecommunication services; or any other delay or failure caused by a third party or otherwise outside of our control. In such an event, we reserve the right to cancel or suspend our services without incurring any liability.
We are not liable for the failure of any equipment or software howsoever caused, wherever located or administered, or whether under our direct control or not, that may prevent the operation of the Services, impede the placing of offers for bets or the matching of bets, or prevent you from being able to contact us.
Please be aware that if you place a bet with the intention of subsequently placing a separate bet to reduce the liability incurred by the initial bet (including by using Betfair's "Cash Out" functionality), there can never be a guarantee that the Services will be available at the point you wish to place the subsequent bet (this is the case regardless of whether or not the unavailability of the Services is due to a matter beyond our reasonable control).
We will not be liable for any failure to perform by a third party to our Agreement.
You agree to indemnify and hold us and our associated companies, affiliates, officers, directors, agents and employees harmless from any liabilities, claims, losses or demands made by any third party arising out of your breach of this Agreement (including documents incorporated by reference) or out of your violation of any law or the rights of any third party.
You acknowledge that Betfair and its affiliates will hold information with respect to your identity, including but not limited to your name, address and payment details. You agree that we rely on this information in entering into this Agreement and you agree to hold us harmless against any falsehood or inaccuracy contained in the information you provide us.
We exclude all representations and warranties as to the satisfactory quality and/or fitness for its intended purpose and/or accuracy and completeness of the Services.
We will not be liable to you for any loss that you may incur as a result of misuse of your password, or in the case of the Telephone Service, of your telephone access number, and we accept no liability resulting from its unauthorised use, whether fraudulent or otherwise.
In no event will we, or any of our suppliers, accept any liability however arising for any losses you may incur as a result of using the Services. Under no circumstances will our liability under this Agreement or for breach of contract, tort, equity or otherwise exceed your exposure limit as specified in your account. This Agreement and the terms expressly incorporated into them constitute the entire and only agreement between the parties with regards to its subject matter and each party confirms that it has not been induced to accept this Agreement in reliance upon, nor has it been given, any warranty (including in particular any warranty as to merchantability, fitness for purpose or uninterrupted functionality), representation, statement, assurance, covenant, agreement, undertaking, indemnity or commitment of any nature whatsoever other than as are expressly set out in this Agreement and, to the extent that it has been, it unconditionally and irrevocably waives any claims, rights or remedies which it might otherwise have had in relation thereto.
No failure or delay by a party to exercise any of its rights under this Agreement shall operate as a waiver thereof and no single or partial exercise of any such right shall prevent any other or further exercise of that or any other right.
This Agreement is governed by the laws of and subject to the jurisdiction of the courts of the country set out in the "Governing Law and Jurisdiction" clause of the relevant Specific Conditions applicable to your particular betting transaction.
Betfair Pty Limited provides an exchange upon which our customers (being Australasian Customers) can make offers for bets and accept offers for bets ("the Exchange").
Please read these Specific Conditions, and the Betting - General Conditions carefully, before betting on the Exchange.
If you and your betting transaction is covered by these Specific Conditions, references to "Betfair", "we", "us" and/or "our" in these Specific Conditions and in the General Conditions are to Betfair Pty Limited.
By entering into any betting transactions on the Exchange, you agree to be bound by these Specific Conditions as well as the General Conditions (together "the Agreement").
You will at all times act in good faith in relation to the counterparties to your bets struck through the Exchange (including Betfair) and such counterparties will be able to enforce this duty directly against you. In particular you will not place bets on the Exchange in breach of any sporting rules, regulations or code of conduct which apply to you.
The Exchange carries offers for bets that remain available for acceptance by you at any time. The identity of the counterparty to your bet is dependent upon where you and other relevant customers reside.
We reserve the right to refuse to post your offer on our Exchange without giving prior notice.
We may restrict you from using programs designed to automatically place bets within certain parameters (e.g. to back or lay at a certain price) ("bots") either generally or in relation to any specific bot if we believe that you have used a bot:
If we do so, we will take reasonable steps to bring this to your attention. In addition to the usual bet matching process, many markets on Betfair use a process called cross-selection matching ("cross-matching") to match bets. When a bet request cannot be matched by an opposing bet on the same selection, cross-matching will attempt to match the bet request with unmatched liquidity on the remaining selections in the market.
We do not guarantee that every offer displayed as outstanding on our site (or communicated by a Betfair Telephone Operator as being outstanding) will be available for your acceptance. All or part of the offer of a bet displayed on our site or communicated by a Betfair Telephone Operator as available on the Exchange at specific odds or price may be successfully cancelled by one or more customers before your acceptance is processed by the Exchange (this risk is particularly relevant where you are using the Telephone Betting Service because your instruction will have to be read back to you before being sent to the Exchange, inevitably causing a further slight delay). In this case, the offer for a bet will be withdrawn before your acceptance of that offer is acknowledged. Your failed attempt to accept the bet formerly on offer will however be posted as an offer to other customers.
We will only allow you to place an offer on the Exchange if you are in compliance with these Terms and Conditions. If we allow you to make an offer for a bet and subsequently suspect that you are or were, at the time of making the offer, in breach of this Agreement, we may, at our absolute discretion, withdraw your offer from our Exchange, void any bets outstanding to your account and terminate your account.
Where you place both a back bet and a lay bet on the same selection at the same price, and your back bet is matched against your lay bet, Betfair will void the bet and no wagering transaction will arise.
Where you place both a back bet and a lay bet on the same selection at the same price, and your back bet and lay bet is matched against other customers, Betfair will void your bets and no wagering transactions will arise with you. In these circumstances, Betfair will match together the outstanding offers for bets made by the other customers.
Betfair acting as counterparty: Where your offer for a bet is matched in whole or in part by Betfair against the counter offer of another Australasian Customer, your offer, or a portion thereof to the extent that only part of it is matched against another Australasian Customer, will be accepted by Betfair as a counterparty in accordance with this Agreement.
Betfair acting as facilitator: Where your offer for a bet is matched in whole or in part against the counter offer of any other customer (i.e. other than an Australasian Customer), your offer, or a portion thereof to the extent that only part of it is matched against that customer, will be accepted by that other party in accordance with this Agreement. In these circumstances, Betfair acts solely as a facilitator and not as a counterparty.
Where Betfair acts as a counterparty:
Betfair is a limited liability company registered in Victoria (ACN 110 084 985). The company is licensed in the Northern Territory of Australia.
Betfair is licensed to operate the Exchange under Australian law. At any time the Exchange may be operated under a licence held by another company affiliated with Betfair and if so Betfair may assign this Agreement to such company.
Whilst it is intended that the Exchange will operate under Betfair's existing licence, we reserve the right to switch the operation of the Exchange to another jurisdiction at any time, including, without limitation, for disaster recovery purposes. In this case another company in an alternative jurisdiction will act as agent for, and provide services to Betfair, to ensure that the Exchange will be available to you, subject to these Specific Conditions and the General Conditions.
You can contact Betfair at any time by sending an email to service@betfair.com.au. Alternatively, the Betfair Call Centre can be called on 1300 238 324 and is available 24 hours a day, 7 days a week, except where closure of the Call Centre is required due to resourcing constraints or operational interruption beyond our reasonable control.
We may, at our sole and absolute discretion, provide you with details of any counterparty to your bets, only if we are satisfied that such counterparties have acted in breach of their duty of good faith. For this purpose, you explicitly consent to the release of your personal data in accordance with the Australian Privacy Act 1988 and any other applicable laws.
Betfair guarantees the full settlement of all wagers matched where those bets or part thereof are matched by Betfair acting as a facilitator or an intermediary. Where any customer does not meet their obligations, Betfair will settle the wager in full.
There is no expiry date on the facility by which customers deposit funds into their accounts.
You may be required to turnover deposited funds before they are able to be withdrawn. Turning over deposited funds means placing bets with the money you have deposited. The amount wagered will determine the amount able to be withdrawn. For example, if you deposit $50 into your account, you may be required to wager $50 before you can withdraw the balance of the account. Betfair reserves absolute discretion in deciding whether a turnover of funds is required by an account holder.
Betfair may, in its absolute discretion, change the exposure limit that applies to your account.
Australasian Customers will not be able to deposit or withdraw via credit cards, digital currencies (such as cryptocurrencies) and payment methods linked to credit cards (including via digital wallets).
This Agreement is governed by the laws of the Northern Territory of Australia and the parties hereby submit to the non-exclusive jurisdiction of the courts of Australia.
These Specific Conditions have been prepared in various languages other than English for reference only. In the event of any differences between the English version of these Specific Conditions and any non-English versions, the English version shall prevail.
